This policy formalizes our commitment to the security and privacy of information collected from users of our interactive services on the IBIZ Tecnologia Platform

1. KEY TERMINOLOGY:

DATABASE: An organized collection of personal or anonymized data.
CONSENT: The voluntary, informed, and explicit authorization by which the USER consents to the processing of their personal or anonymized data.
CONTENT: All forms of information, data, communications, software, multimedia content, and services accessible to USERS on the PLATFORM.
COOKIES: Files sent by the PLATFORM’s server to the USER’s computer to identify the computer and obtain access data, such as browsed pages or clicked links, thus enabling personalized use of the PLATFORM according to the USER’s profile. They may also be used to enhance the security of USERS on the PLATFORM. For example, cookies are used to remember your login information, personalize your browsing experience, and track website traffic.
PERSONAL DATA: All data related to an identified or identifiable natural person, non-public, concerning the identity and private life of its HOLDER.
ANONYMIZED OR ANONYMIZED PERSONAL DATA: data related to a HOLDER who cannot be identified.
IP (Internet Protocol): A set of numbers identifying the User’s computer on the Internet
POP-UPS: Windows or alerts that appear automatically on the internet when accessing the PLATFORM.
LOGS: records of USER activities and interactions within the PLATFORM.
DATA MESSAGES: Information generated, sent, received, stored, or communicated electronically.
IBIZ: The entity holding exclusive intellectual property rights pertaining to the PLATFORM.
IBIZ PLATFORM: Comprises a proprietary system with rights reserved to IBIZ. It may also be referred to in this Document as “PLATFORM”, accessed by computers, notebooks, smartphones or tablets.
SERVICE or SERVICES:Services offered through the PLATFORM
SESSION ID: Identification of the USER’s session during PLATFORM usage.
TERMS AND CONDITIONS OF USE OF THE PLATFORM or TERMS OF USE: Legal terms regulating the relationship between IBIZ and USERS
HOLDER: The natural person who is the PLATFORM user, identified in this Document as USER.
IBIZ PLATFORM USER: Individuals or legal entities registered on the internet PLATFORM, also called: “USER” or “USERS”. IBIZ and the USER may be referred to individually in this Document as “Party” or jointly as “Parties”.

2. DATA AND INFORMATION COLLECTION:

2.1 Data and information (whether PERSONAL or ANONYMIZED) will be collected when the USER: (a) Starts using the PLATFORM SERVICES; (b) Interacts with the various tools available on the PLATFORM, providing information (information may be collected involuntarily through cookies, which track your browsing activity on the PLATFORM); or (c) Contacts through available communication channels on the PLATFORM.

2.2 By clicking <I ACCEPT> , the User provides explicit and unequivocal consent to receive communications from IBIZ Tecnologia and its affiliated partners. This consent extends to communications delivered through various channels, including but not limited to: a) Email b) The Platform c) Third-party websites. While consent is given upon acceptance, the User retains the right to opt out of certain types of communications as permitted by applicable laws. Instructions for opting out will be provided within the communications or through the User’s account settings.

2.3. Communications may include but are not limited to: a) Service updates and notifications b) Marketing and promotional materials c) Surveys and feedback requests d) Important account-related information.

3. DATA AND INFORMATION STORAGE:

3.1 All DATA MESSAGES and information collected from USERS will be incorporated into the PLATFORM DATABASE, for which IBIZ is responsible and the owner. The collected data and information will be encrypted during transmission and stored in a secure environment, following the available technical standards, and can only be accessed by qualified and authorized individuals at IBIZ. Furthermore, IBIZ states that it will not share, sell, or present the USERS’ PERSONAL DATA to third parties. Furthermore, IBIZ states that it will not share, sell, or present the USERS’ PERSONAL DATA to third parties.

3.2 Considering that no security system is absolutely secure, IBIZ disclaims any liability for potential damages or losses arising from failures, viruses, or database breaches on the PLATFORM, except in cases of fraud or willful misconduct by IBIZ.

4. USE OF DATA AND INFORMATION:

The data and information collected from Users (whether PERSONAL or ANONYMIZED) may be used by IBIZ for the following purposes: (a) To respond to your questions and requests; (b) To communicate with you about your account or PLATFORM activity; (c) To provide access to restricted areas or exclusive features on the PLATFORM; (d) To comply with legal obligations; (e) To protect the safety and security of USERS; (f) To create general statistics to identify the USERS’ profile (only ANONYMIZED DATA will be shared with third parties); (g) To establish, defend, or exercise rights in legal proceedings.

5 ABOUT EMAILS:

5.1 Emails sent directly by IBIZ do not contain attachments for download nor request USERS’ data. Users are advised to exercise caution and report any suspicious emails that claim to be from IBIZ but do not adhere to these guidelines.

5.2 The USER agrees to receive communications and content from IBIZ and its partners. In the case of emails sent by IBIZ or third parties, the USER will always have the option to stop receiving them, except for those necessary to establish communication resulting from PLATFORM activity or to identify the data and information recipient.

6. ACTIVITY LOGS:

IBIZ IBIZ may log the USER’s activities on the PLATFORM through LOGS: (a) USER’s IP address; (b) USER’s actions on the PLATFORM; (c) Pages accessed by the USER; (d) Dates and times of each action and access to each PLATFORM feature; (e) USER’s SESSION ID, when applicable. The collected logs may be utilized by IBIZTecnologia for the following purposes: a) Fraud investigations b) Detection and prevention of improper modifications to systems and registrations c) Enhancement of Platform security and user experience d) Compliance with legal and regulatory requirements

7. COOKIES:

The PLATFORM may use COOKIES, and you can configure your internet browser to block them if desired. However, blocking cookies may prevent you from logging in, saving your preferences, or using certain features of the PLATFORM. By accepting this Privacy Policy, you expressly authorize IBIZ to use COOKIES in all activities performed on the PLATFORM.

8. GENERAL PROVISIONS:

The provisions in this Privacy Policy may be updated or modified at any time, and it is the USER’s responsibility to check them whenever accessing the PLATFORM. The USER should contact us if they have any questions regarding the provisions in this Privacy Policy and Use at contato@ibiz.net.br

9. USER CONDUCT IN THE USE OF THE PLATFORM:

USER behavior while utilizing the PLATFORM is governed by all relevant legal statutes and regulatory frameworks.. The USER is solely responsible for the information provided from registration to the content of their communications with IBIZ via the PLATFORM.
When publishing information or using any communication service or other interactive service available on the PLATFORM, the USER agrees not to send, share, publish, distribute, or facilitate the distribution of any CONTENT, including text, communications, software, images, sounds, DATA MESSAGES, or other information.
Additionally, the USER agrees not to use language, practices, or actions that are illegal or potentially offensive to IBIZ, its team, or third parties.
The USER understands that any complaints should be directed to the email address provided by IBIZ. The USER must not use private platforms like “RECLAME AQUI” or similar platforms, social media, or any other means not stipulated in this Agreement to raise a complaint.
The USER must always:

Provide truthful and accurate information when creating their user account;
Refrain from transferring validation data (username and password) to third parties;
Immediately inform IBIZ in the event of forgotten or compromised validation data;
Refrain from impersonating other USERS
Avoid decoding, dismantling, or disassembling any element of the PLATFORM or any of its parts.

IBIZ reserves the right to cancel or suspend USER accounts and/or prohibit access to the PLATFORM for USERS who engage in conduct that violates these terms or fails to fulfill contractual obligations.

10. PLATFORM OPERATION

10.1 IBIZ manages the PLATFORM directly or through third parties, ensuring that all information communicated is accurate and up-to-date. Under no circumstances shall it be liable for direct or indirect damages suffered by the USER from the use or inability to use the PLATFORM.

10.2 The PLATFORM is available 24 hours a day for access and consultation. IBIZ makes its best efforts to keep the PLATFORM operational but does not guarantee the PLATFORM’s availability and continuous uptime. There may be voluntary or involuntary interruptions.

10.3 IBIZ may, at its sole discretion, change the layout of the information and suspend or cancel any services, products, utilities, functionalities, or applications available on the PLATFORM at any time.

11. INDUSTRIAL PROPERTY AND COPYRIGHT INFORMATION:

The USER acknowledges and agrees that all CONTENT presented on the PLATFORM is protected by copyrights, trademarks, patents, or other industrial property rights and laws and is the exclusive property of IBIZ.
The USER may only use the CONTENT as expressly authorized by IBIZ, solely for personal use, without implying any license transfer of the PLATFORM.
The USER may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from the PLATFORM in any way or by any means without prior written permission from IBIZ.
Unauthorized use of the materials appearing on the PLATFORM may violate copyright, trademark, and other applicable laws and may result in criminal or civil penalties.
The USER should not send confidential information to IBIZ unless both Parties have mutually agreed in writing. Any unsolicited ideas or proposals sent by the USER to IBIZ do not grant the USER any rights.

12. LIMITATION OF LIABILITY:

All materials and services made available on the PLATFORM are provided “as is” and “as available” basis. IBIZ Tecnologia expressly disclaims all warranties of any kind, whether express or implied, including but not limited to: a) Implied warranties of merchantability b) Fitness for a particular purpose c) Non-infringement.
BIZ Tecnologia cannot ensure that results obtained through the use of the Platform will meet User expectations or be free from errors or defects. While IBIZ Tecnologia strives to maintain Platform operability, it does not guarantee permanent availability or continuity of it.
The use of services or downloading through the PLATFORM is at the USER’s discretion and risk. The User agrees to be solely responsible for any damage to their computer system or loss of data resulting from the use of the Platform or its services.
The USER also understands and agrees that IBIZ has no control over third-party networks that may be accessed during PLATFORM use, so delays and interruptions in other network transmissions are entirely beyond its control and responsibility.
IBIZ shall not be held liable for any acts of God or force majeure that may cause damages to either Party. Under no circumstances shall IBIZ be liable to the USER or third parties for any damages, including, but not limited to, those resulting from data loss or third-party services offered via the PLATFORM.
The USER is aware that the information shared by IBIZ does not mandate or encourage decision-making or serve as advice. Under no circumstances shall IBIZ Tecnologia be liable to the User or any third parties for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to: a) Loss of profits b) Loss of data c) Loss of use d) Loss of business opportunities. This limitation applies even if IBIZ Tecnologia has been advised of the possibility of such damages.
At no point will IBIZ request information from the USER that is not necessary for PLATFORM access. The User acknowledges that information shared by IBIZ Tecnologia: a) Does not mandate or encourage decision-making b) Does not serve as professional advice (legal, financial, medical, or otherwise).
At no time will IBIZ ask the USER for information that is NOT necessary for access to the PLATFORM.

13. SECURITY AND PASSWORD:

The User is solely responsible for maintaining the confidentiality of their account credentials, including but not limited to their password and username, and assumes full responsibility for all activities, statements, acts, and omissions that occur through the use of their account. The User is accountable for all data and information associated with the account. Users are strongly advised to implement robust security measures to prevent unauthorized access to their account. It is recommended that Users log out of the Platform after each session to mitigate the risk of unauthorized navigation by third parties
The USER is strictly prohibited from transferring or sharing their account with third parties, and IBIZ reserves the right to immediately terminate the USER’s account in such cases without any payment, compensation, or reparation.
IBIZ Tecnologia does not request passwords via phone or email. The user should log out of the PLATFORM after each session to prevent unauthorized navigation by third parties and irregular use of their password. IBIZ Tecnologia shall not be held liable for any unauthorized access or use of User accounts resulting from the User’s failure to comply with these security guidelines. The User agrees to notify IBIZ Tecnologia immediately upon becoming aware of any breach or unauthorized use of their account.

14. FULL ACCEPTANCE OF TERMS

The USER declares they have the legal capacity to give their EXPRESS CONSENT to the terms outlined in this Agreement and accept all situations regulated in this document.

Occasionally, updates to this Agreement may be made, at which time the last updated date displayed at the top of the statement will also be updated.
